TERMS & CONDITIONS

DEFINITIONS

‘RIC’ means Rock Island Charters.

‘Customer’ means the person, company or organisation booking a trip.

“Fee” means the cost of the trip as published on the RIC website or otherwise agreed with the skipper.

1. BOOKING

1.1
A booking will be provisional until RIC receives a Deposit or full Payment as defined in Section 2 below

1.2
Upon receipt of the above RIC will confirm the booking with the customer and you will be informed with all the information required including departure points, directions and postcodes of nearest carparks.

1.4
A copy of these Terms and Conditions of Booking is available on the RIC Company Website or by email on request.

2. DEPOSIT OR PAYMENT

2.1
A deposit by prior arrangement with the skipper of the total fee may be required for booking the whole boat via on line bank transfer to RIC company account. The remainder of the Fee is payable on the day.

2.3
When using the boats equipment you accept full liability for all loses/ breakages to be paid for in full before departure Reels £80 per unit and Rods £90per unit

3. GIFT VOUCHERS

3.1
Gift Vouchers are valid for 12 months from the date of purchase and CANNOT be refunded, be aware RIC does not always trade through the winter season therefore vouchers can only be redeemed whilst RIC is actively trading.

3.2
There is no cash alternative if the recipient chooses a trip to a lower cost than the Voucher value, or does not redeem their Voucher.

3.3
The Voucher can be redeemed against a more expensive trip, the difference to be paid on the day.

3.4
Our trips get booked up quickly on a first come first served basis, especially in summer. Therefore it is best for the recipient to get a date booked in promptly upon receipt of their Voucher.

3.5
All trips are weather and demand dependant and if the sea is too rough or we don’t have sufficient bookings to run the trip it will be postponed. In this event the recipient can simply choose another available date.

4. CANCELLATION OR REDUCTION OF PERSONS BY CUSTOMER

4.1
More than 4 weeks before the booked date then the Deposit or Payment is refunded.

4.2
Less than 4 weeks before the booked date then the Deposit or Payment is forfeited.

4.3
Less than 2 weeks before the booked date then the full Fee is payable, this includes a reduction in persons on small group bookings.

4.4
If the Customer requests an early return to shore then the full Fee is payable

4.5
The vessel WILL NOT return to port on individual trips for seasickness unless agreed by all parties on board.

4.6
The Customer may change the date of their trip with a minimum of 2 weeks notice.

4.7
Late arrivals will not be entitled to rebook or a refund, you must be at the designated departure point no later than 20 minutes before the departure time of the trip.

Sometimes due to tides, weather or port restrictions the charter may sail slightly earlier or later than planned and therefore it is the customers responsibility to leave enough spare time to park and ensure they are at the designated departure point 20 mins before departure, the boat will not wait for the customer if you are late the boat will sail and you will not be refunded.

5. CANCELLATION BY RIC

5.1
Due to bad weather on the morning of the trip, the Customer has the option of the Deposit or Payment being refunded or moved to another available date.

5.2
Due to illness, mechanical breakdown or other unforeseen circumstances, the Customer has the option of the Deposit or Payment being refunded or moved to another available date.

5.3
RIC cannot be held liable for any consequential loss incurred by the Customer if RIC has to cancel the trip.

5.4
RIC will await instruction from the Customer to reschedule or refund the Deposit or Payment if the trip cancelled by RIC.

5.5
Deposits will be refunded same day.

6. WEATHER AND CONDITIONS

6.1
You will receive a courtesy text message from RIC the day before the trip to confirm weather and finalise departure details, Failure to reply will be taken as acceptance by the Customer of any decisions made by RIC for the following day.

6.2
Phone signal at sea and certain areas on land in Helford Passage/Falmouth estuary can be intermittent therefore if the customer does not receive a text message it is the customers responsibility to contact RIC by 2100hrs the day before the trip to confirm weather and finalise details. Failure to do so will be taken as acceptance on decisions as stated in 6.1 above.

6.3
RIC decision is final with regard to the weather but we try to get out if possible with due regard to safety and common sense.

6.4
RIC reserves the right to alter the planned trips and timings with regards to weather, fishing and embarkation/disembarkation conditions, for example a wreck fishing trip may have to become an inshore Reef trip in the event of strong onshore winds or algae bloom.

7. ALCOHOL, DRUGS AND BEHAVIOUR

7.1
Due to changes in insurance company requirement only a small quantity of low strength alcohol will be allowed on board and always at the discretion of the Skipper.

7.2
The use of illegal Drugs is strictly prohibited. Drug abuse or excessive alcohol consumption will cause an immediate return to port and RIC may alert the relevant authorities if deemed necessary.

7.3
Any injury or loss sustained on board must immediately be reported to the Skipper.

7.4
Infants and dogs will only be taken with prior agreement of the Skipper.

7.5
RIC Vessel, TIDOS is licensed for a maximum of three passengers and one crew.

7.6
Any medical conditions that might affect a customer during the trip MUST be reported to the Skipper before departure.

7.7
Unruly or abusive behaviour will not be tolerated on any of our charters, if any of our staff deem a customers behaviour unsuitable or offensive at any point whilst on board RIC has the right to terminate the charter and return to port with no refund given

8. DEPARTURE INFORMATION

8.1
Due to Helford Passage pontoon drying out on spring tides some trips may have to factor this in. All information regarding departure and return will be provided by RIC two days before departure.

8.2
The boat will not wait for late arrivals, if you miss the boat you are not entitled to rebook or a refund.

You must arrive at your departure point (as stated in the rest of section 8 below) no later than 20 minutes before your designated departure time.

9. INSURANCE AND LEGAL

9.1
Anything you catch you can keep if above the legal minimum landing size and not subject to a landing ban. In the interests of conservation at RIC we practise the return of all Conger Eels, Shark and most Rays.

9.2
It is illegal to sell any fish caught on board.

9.3
RIC Vessel and Skipper are licensed to operate as required by the MCA – Maritime and Coastguard Agency.

9.4
RIC maintains £2 million Public Liability Insurance.

9.5
These Terms and Conditions of Booking and all other express and implied terms of the contract shall be governed and construed in accordance with the laws of England and the parties agree to submit to the jurisdiction of the courts of England and Wales.

9.6
Nothing in these Terms and Conditions of Booking shall affect the rights of Consumers.

9.7
All clauses and sub-clauses of this Agreement are severable and if any clause or identifiable part thereof is held to be unenforceable by any court of competent jurisdiction then such enforceability shall not affect the enforceability of the remaining provisions or identifiable parts thereof in these Terms and Conditions of Booking.
